Massive Fine Imposed for Overbuilding

The home at 1565 Bellwood Road has been the source of controversy for some time now.

Construction for a single story addition and remodel project began earlier this year, but exceeded the height in the plans by four feet. Because of that, the owner had to stop construction, go back to the Design Review Committee to get approval for the modified height and pay a penalty fee of $12,290.15.

Though the DRC approved the modification, neighbors appealed to the Planning Commission and the plans were denied. Ban Tieu, the owner, returned to the DRC with a new roof design of 16 feet 5 inches, which was approved.

Tieu requested a refund of the fine because the height discrepancy was only six inches, according to him, and the plans were followed in every aspect. The city council voted 4-1 to deny his request, with Dennis Kneier as the dissenting vote.
