City Attorney Steve Dorsey taught a training session for the San Marino Design Review Committee recently on principles of ethics, conflict of interest laws, the Ralph M. Brown Act and due process.
The conversation ended on how the Committee conducts its open forum, which allows people who want to apply to the DRC a chance to receive initial responses and it gives agendized applicants extra discussion time on their project that was just approved, denied or continued. Dorsey said he was concerned the forum would not allow for due process and that the applicant would think applying comments from open forum meant a guaranteed approval.
It may also violate the Brown Act as they are discussing items not specifically on the agenda.
He suggested anyone there for open forum should meet with only two committee members total, and to rotate who those members are at each meeting.
