Ownership Not Required to be on San Marino Design Review Committee

The requirement of Design Review Committee members and Planning Commissioners to own property in the city of San Marino is out of line with the law.

San Marino City Council discussed the matter Friday, July 31, but ultimately decided to take action during their September meeting. Mayor Eugene Sun said he did not want the public to think this was happening “under the radar” considering many residents are on vacation at this time.

Not all councilmembers were pleased with that decision. Councilmember Dennis Kneier said it’s clear the law does not require property ownership.

“We have no choice on the matter,” he said. “Let’s fix the ordinance right now.”

The code currently states: “All members of the Planning Commission shall be persons residing and owning property in the city” and “All members of the Design Review Committee shall be persons residing and owning property in the city.”
